Thank you for visiting our website https://www.dcmfilm.com/ and for your interest in what we offer. When you use our services, your personal data may be processed. Protecting your data is always important to us. This privacy policy explains how we process personal data and what rights you have.
You can view and print this privacy policy on our website at any time.
I. General information
This privacy policy informs you about how we handle your personal data when you use our website. In particular, it explains which data we collect and what we use it for. It also tells you how and for what purpose this happens.
Personal data (“data”) is any information relating to an identified or identifiable person. “Processing” of data means any operation performed on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. The legal basis of data protection is set out in particular in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“General Data Protection Regulation”, GDPR), as well as in the German Federal Data Protection Act (BDSG), the German Telemedia Act (DDG) and the German Act on Data Protection and the Protection of Privacy in Telecommunications and Telemedia (TDDDG).
We treat personal data confidentially, in accordance with the statutory data protection regulations and on the basis of this privacy policy. We only process your data to the extent necessary to provide a functional and user-friendly online presence or website and our content and services. Not providing the data may have legal disadvantages, such as a contract not being able to be performed.
II. Controller
The controller responsible for processing your data is
DCM Film Distribution GmbH
Schönhauser Allee 8
10119 Berlin
Germany
Phone: +49 (0)30 88 59 74-0
Email: hallo@dcmteam.com
The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.
III. Scope of data processing
We only process your data to the extent necessary to provide a functional and user-friendly online presence or website and our content and services. Not providing the data may have legal disadvantages, such as a contract not being able to be performed. For data processing we use various third-party providers in the areas of hosting, online marketing, mailing services and customer/data management (CRM), each of which processes data on our behalf. Where these third parties are processors, we have concluded corresponding data processing agreements with them which ensure that an adequate level of data protection is guaranteed by our processors too (Art. 28 GDPR).
IV. Data security
We have taken technical and organisational measures to ensure that the data protection regulations are observed both by us and by external service providers. For security reasons and to protect the transmission of confidential content, such as content you send to us as the site operator, our website uses SSL or TLS encryption.
V. Processing of personal data
The following overview lists all types of data we process, the purposes of their processing and the legal bases for it.
1. Use of the website
When you use our website without otherwise sending us data (e.g. by registering or using the contact form), we temporarily collect the following data on our web server in anonymised form via server log files:
- the website from which our website was requested (referrer URL)
- name and URL of the requested website
- date and time of access to the website
- description of the type, language and version of the web browser used
- IP address of the requesting computer, shortened so that it can no longer be linked to a person
- whether the access was successful (access status/HTTP status code)
- internet service provider of the accessing system
- amount of data transferred in each case
- operating system used and its interface
- the time zone difference to GMT
This processing is technically necessary to display our website to you. We also use the data for statistical evaluations to ensure the operational security and stability of our website. The legal basis for this processing is Art. 6(1)(f) GDPR. Processing this data is necessary to provide the website and to ensure its stability and operational security, and thus serves a legitimate interest of our company. We also use the data to fulfil our legal obligations for reasons of data security. The legal basis for this processing is Art. 6(1) sentence 1(c) GDPR.
2. Contacting us
When you write to us, e.g. by sending us an email or contacting us via the contact form, we store the contact details you provide, such as your name, address, mobile number, email address and the information given in your request.
If you contact us within an existing contractual relationship or in advance to find out about our range of services or our other services, the data and information you provide are processed to handle and answer your request on the legal basis of Art. 6(1) sentence 1(b) GDPR. If you have consented to the processing for the purpose of answering your request, the legal basis is Art. 6(1) sentence 1(a) GDPR. Otherwise, we process your data to safeguard our legitimate interests in properly answering customer and contact requests in accordance with Art. 6(1) sentence 1(f) GDPR.
3. Job applications
When you apply for a position with us, we process the information and personal data you provide for the purpose of handling the application process. This data includes your name, email address, address and telephone number, age, professional background, qualifications, country of residence, language skills and any other personal information you provide in the course of your interaction with us. We may also ask you for additional information that helps us in our recruitment process and, if you are offered a position, for example your date of birth and your employment documents. Processing may also take place electronically. This is particularly the case when an applicant sends us application documents electronically, for example by email.
We process your personal data to fulfil our contractual or pre-contractual obligations (on the legal basis of Art. 6(1) sentence 1(b) GDPR) or, where applicable, to carry out the employment relationship with you (Section 26 BDSG). If you have consented to the processing for the purpose of handling your application, the legal basis is Art. 6(1) sentence 1(a) GDPR.
If we do not conclude an employment contract with the applicant, the application documents are automatically deleted two months after the rejection has been communicated, unless other legitimate interests prevent deletion. Such another legitimate interest is, for example, a duty to provide evidence in proceedings under the German General Equal Treatment Act (AGG).
4. Newsletter
Our newsletter keeps you informed about us and our offers. To subscribe to the newsletter, we only need your email address and your name. When you subscribe, your email address is transmitted to us (or our mail provider) and stored there. After subscribing, you receive an email asking you to confirm your subscription (“double opt-in”). In this context, we (or our mail provider) process the following data:
- contact details (email address, name)
- device data (device name, where applicable country code, language, name and version of the operating system)
- connection data (IP address, mail provider)
- date and time of subscription and confirmation
We send our newsletter on the basis of your prior express consent, Art. 6(1) sentence 1(a) GDPR. Where we commission a service provider to send emails, we do so on the basis of our legitimate interest in efficient and secure delivery. The legal basis in this respect is Art. 6(1) sentence 1(f) GDPR.
You can withdraw your consent to the processing of your data for sending the newsletter or for analysing the related data at any time. You can do so via a link included in every newsletter or by sending us a separate message. This incurs no costs other than the transmission costs at the basic rates.
Mailchimp
We use the provider Mailchimp. Mailchimp is a service for organising and analysing the sending of newsletters. For this purpose, we pass on your email address and the information whether you have subscribed to the newsletter and/or to further product information to Mailchimp.
Mailchimp allows us to analyse our newsletter campaigns. When you open an email sent with Mailchimp, a file contained in the email (a so-called web beacon) connects to Mailchimp’s servers in the USA. This lets us see whether a newsletter was opened and which links were clicked. Technical information is also recorded (e.g. time of subscription, IP address, browser type and operating system). This information is used for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipients.

5. Cookies
On our website we use cookies that are offered either by us or by third parties.
Cookies are small text files that are placed on the device you use and stored by the browser. Cookies serve to make our offer more user-friendly, more effective and more secure. There are different types of cookies used for different purposes. Some cookies ensure that our offers work properly or that you are recognised on your device after a successful registration (“necessary” cookies). By placing these necessary cookies we make it easier for you, for example, to visit our offers and use the services available there. We place other cookies to analyse user preferences and thus improve our offers (“extended cookies”). We use them, for example, for tracking (e.g. interest-/behaviour-based profiling), remarketing, visit action evaluation, conversion measurement, reach measurement (e.g. access statistics, recognition of returning visitors), building target groups and cross-device tracking. We only set non-necessary cookies with your consent. When you visit our offers for the first time, a pop-up is displayed (“cookie banner”) in which the individual cookies are described in more detail. There you can allow or reject cookies according to your preferences. You can change your settings at any time here [link to the cookie banner]. Please note that deactivating cookies may limit the functionality of this website.
When cookies are used, the following data is processed, depending on the browser settings:
- usage data (e.g. websites visited, interest in content, access times),
- meta/communication data (e.g. device information, IP addresses)
- location data (data indicating the location of an end user’s device)
Where personal data is processed when “necessary” cookies are used, this is based on Art. 6(1) sentence 1(f) GDPR on the grounds of legitimate interests in quality assurance and a technically flawless display of the website. The processing of personal data when so-called “extended cookies” are used is based on your consent (Art. 6(1) sentence 1(a) GDPR).
Borlabs Cookie
We use Borlabs Cookie on our website. When you visit our website, you can select your preference regarding the use of cookies in the cookie banner. The borlabs-cookie cookie stores the cookie consents you gave when entering the website. It thus enables basic functions and is required for the website to work properly. This constitutes a legitimate interest; the legal basis is Art. 6(1)(f) GDPR.
Borlabs Cookie, Benjamin A. Bornschein, Georg-Wilhelm-Str. 17, 21107 Hamburg, website: https://de.borlabs.io/, privacy policy: https://de.borlabs.io/datenschutz/.
6. Plug-ins and similar technologies
On our website we use so-called pixel tags (invisible graphics, also known as “web beacons”) and other technologies of the third-party providers listed below for marketing purposes and to provide our content. The “pixel tags” allow information such as the visitor traffic on the pages of this website to be analysed. The pseudonymous information may also be stored in cookies on the users’ devices and contain, among other things, technical information about the browser and the operating system, referring websites, the time of the visit and other details about the use of our online offer, and may be combined with such information from other sources.
When pixel tags are used, usage data (e.g. websites visited, interest in content, access times), meta/communication data (e.g. device information, IP addresses) and location data are processed. We process this data for the purpose of displaying fonts, direct marketing (e.g. by email or post), tracking (e.g. interest-/behaviour-based profiling, use of cookies) and interest-based and behavioural marketing. The processing of this data is based on your consent; the legal basis is Art. 6(1) sentence 1(a) GDPR.

7. Analytics and advertising
Google Analytics
On our web pages we use Google Analytics, a web analytics service of Google LLC. In this context, pseudonymised usage profiles are created and cookies are used (see “Cookies” above). The information generated by cookies about your use of this website, such as browser type/version, operating system used, referrer URL (the previously visited page), host name of the accessing computer (IP address) and time of the server request, is transmitted to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide further services related to website and internet use for the purposes of market research and the needs-based design of these web pages. This information may also be transferred to third parties where required by law or where third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymised so that they cannot be attributed (IP masking).
You can prevent the installation of cookies by setting your browser accordingly; however, please note that in this case you may not be able to use all functions of this website to their full extent. This processing is only carried out if you have given your express consent in accordance with Art. 6(1)(a) GDPR.
You can also prevent the collection of the data generated by the cookie and relating to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (http://tools.google.com/dlpage/gaoptout?hl=en).

Facebook Pixel
We use the Facebook Pixel on our website. This allows interest-based ads (“Facebook Ads”) to be shown to users of our website when they visit Facebook or other websites that also use this method. We use the Facebook Pixel to show the Facebook Ads we place only to Facebook users who have also shown an interest in our online offer. With the help of the Facebook Pixel we want to ensure that our Facebook Ads match the potential interest of the users. The Facebook Pixel also enables us to track the effectiveness of Facebook Ads for statistical purposes by seeing whether users were redirected to our website after clicking on a Facebook Ad.
Access statistics, data such as locations of access, device data, duration and time of access, navigation behaviour, click behaviour and IP addresses may be processed. This processing is only carried out if you have given your express consent in accordance with Art. 6(1)(a) GDPR.
Through the Facebook Pixel, your browser automatically establishes a direct connection with the Facebook server. We have no influence on the scope and further use of the data collected by Facebook through the use of this tool. Only the providers have access to the users’ data and can take appropriate measures and provide information directly.
You can object to the collection by the Facebook Pixel and the use of your data to display Facebook Ads. To set which types of ads are shown to you within Facebook, you can go to the page set up by Facebook and follow the instructions there on the settings for usage-based advertising: https://www.facebook.com/settings?tab=ads. The settings are platform-independent, i.e. they are applied to all devices, such as desktop computers or mobile devices.

8. Online shop
If you wish to order in our online shop, the conclusion of the contract requires you to provide the personal data we need to process your order. We process our customers’ data to enable them to select, purchase or order the chosen products, goods and related services, and to pay for them and have them delivered or performed. The mandatory information required to process the contracts is marked separately; further information is voluntary. In this respect we process, for example, master data (e.g. names, addresses); payment data (e.g. bank details, invoices, payment history); contact details (e.g. email, telephone numbers); contract data (e.g. subject matter, term, customer category). Customer data is processed to perform the contracts concluded via the online shop on the legal basis of Art. 6(1) sentence 1(b) GDPR.
Shopify
We use the shop system of the service provider Shopify for the purpose of hosting and displaying the online shop on the basis of processing on our behalf. All data collected on our website is processed on Shopify’s servers. Within the scope of Shopify’s services mentioned above, data may also be transferred, as part of further processing on our behalf, to Shopify Inc., 150 Elgin St, Ottawa, ON K2P 1L4, Canada, Shopify Data Processing (USA) Inc., Shopify Payments (USA) Inc. or Shopify (USA) Inc.

9. Social media
We are present on the following social media platforms and process users’ data there in order to communicate with the users active there or to provide information about us:
- Facebook, Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland; https://www.facebook.com; privacy policy: https://www.facebook.com/about/privacy; additional data protection information: agreement on the joint processing of personal data on Facebook Pages: https://www.facebook.com/legal/terms/page_controller_addendum, data protection information for Facebook Pages: https://www.facebook.com/legal/terms/information_about_page_insights_data.

- Vimeo, Vimeo.com Inc., 555 West 18th Street, New York, New York 10011, USA; website: https://vimeo.com/, privacy policy: https://vimeo.com/privacy.
Please note that users’ data may be processed within social networks for market research and advertising purposes. For example, usage profiles can be created based on users’ behaviour and the resulting interests. These usage profiles can in turn be used, for example, to place ads inside and outside the networks that presumably match the users’ interests. For these purposes, cookies are usually stored on users’ computers in which the usage behaviour and interests of the users are stored. Usage profiles may also store data independently of the devices used (in particular if the users are members of the respective platforms and are logged in to them). For a detailed description of the respective forms of processing and the options to object (opt-out), please refer to the privacy policies and information of the operators of the respective social media providers. In the case of requests for information and the exercise of data subject rights, too, please note that these can be asserted most effectively with the providers. Only the providers have access to the users’ data and can take appropriate measures and provide information directly. If you still need help, you can contact us.
VI. Storage and deletion of data
The data we process is deleted in accordance with the statutory requirements as soon as the consents permitting its processing are withdrawn or other permissions cease to apply (e.g. when the purpose of processing this data no longer applies or the data is not necessary for that purpose). This means that we only store your personal data for as long as it is necessary for the respective processing purpose and limit the storage period to the necessary minimum. Beyond that, we only store your data if we are entitled or obliged to do so under statutory retention periods (e.g. under the German Commercial Code (HGB) or the German Fiscal Code (AO)).
Our data protection notices may also contain further information on the retention and deletion of data, which takes precedence for the respective processing.
VII. Your rights
You have the following rights:
- the right of access,
- the right to rectification or erasure,
- the right to restriction of processing,
- the right to data portability,
- the right to withdraw consent you have given with effect for the future.
- the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Art. 6(1) sentence 1(e) or (f) GDPR; this also applies to profiling based on these provisions.
To exercise the rights listed above, you can send an email to hallo@dcmteam.com. You also have the right to lodge a complaint about the processing of your personal data with a data protection supervisory authority.
VIII. Disclosure of data / transfers to third countries
We generally only pass on your data to third parties if you have consented to this or there is another legal basis. Where we use tools from third-party providers that process your data outside the EU/EEA, we ensure that the legal requirements of Art. 44 et seq. GDPR for such a transfer to a third country are met and that your data is processed in the third country concerned in accordance with the European data protection standard. For this purpose we regularly use the so-called EU standard contractual clauses (SCC), which we conclude with the respective provider. In addition, in accordance with the requirements of the CJEU (“Schrems II”), a case-by-case risk analysis is carried out for each transfer to a third country to ensure that your data is processed lawfully in that country and, in particular, that access to your data by public authorities is prevented.
IX. Data processing when accessing linked content
This privacy policy only applies to this website. However, the website may contain external links or hyperlinks to websites of other providers. These are to be distinguished from our own content. This third-party content does not come from us, nor do we have any influence on the content of third-party pages. If you are redirected to other pages via links on the website, please inform yourself there about how your data is handled.
X. Automated decision-making/profiling
We do not use automated decision-making or profiling (an automated analysis of your personal circumstances).
XI. Changes to this privacy policy
As our website and the offers on it develop, or due to changes in legal or regulatory requirements, it may become necessary to change this privacy policy.
